1. General
1.1 These general terms and conditions apply to the websites www.skyando.co.uk. These are operated by neoda Solutions GbR (hereinafter: neoda Solutions).
1.2 neoda Solutions reserves the right to change the terms at any time for the future.
1.3 "User" in the sense of these GTC is any visitor to the neoda Solutions internet presence who makes use of the services offered by neoda Solutions. The terms of use valid at the time of the user's specific visit or the specific use of services on the neoda Solutions internet presences are applicable. By using the websites and/or making use of services, the user declares their full agreement to these General Terms of Use.

2. Services
2.1 neoda Solutions acts exclusively as an intermediary for transport, accommodation and related services (flight bookings, package holidays, hotel bookings, car hire, etc.). neoda Solutions is not a tour operator. In the event of a booking, the relevant contract (depending on the product, tour operator, airline, hotel operator, car rental company) is concluded exclusively between the user and the respective tour operator or provider.
2.2 neoda Solutions does not guarantee the completeness or accuracy of the requested travel data, information, and prices. These are non-binding indications of possible offers from third-party companies to which the user is forwarded, and not legally binding offers.
2.3 The displayed prices are gross prices including VAT. The amount and availability of prices can change at any time. Price changes by providers may only be reflected in our system with a time delay due to technical reasons. There is no legal entitlement to the displayed prices. The percentage figures for deal prices on the homepage are calculated from the percentage deviation from the average of the cheapest prices for the respective flight connection over the last 30 days.
2.4 Our contractual obligation is limited to arranging the offered and bookable services. The execution of the booked trip as such is not part of our contractual obligations.
2.5 neoda Solutions receives commission payments from some airlines and travel agencies for successful mediation. The user agrees to this. Airlines and travel agencies from which neoda Solutions does not receive commission payments are expressly not excluded from the price comparison or are displayed lower down in the search results. skyando thus enables a neutral price comparison. Only those airlines and travel agencies that cannot provide their prices to neoda Solutions cannot be considered on skyando.
2.6 neoda Solutions expressly distances itself as a precaution from the content and design of the provider pages to which links from skyando lead. The user is obliged to check significant information himself for accuracy and conformity with the travel data provided on skyando before concluding a contract with the respective provider. This applies in particular to the information on the currently valid price. Any liability of neoda Solutions for conformity with the data on skyando is excluded.
2.7 neoda Solutions reserves the right to change or terminate the agreements for commission models with partners within the skyando Affiliate Programme with a notice period of 4 weeks and with prior announcement.

3. User Obligations
3.1 The services may be used exclusively for private purposes. The minimum age for participation is 18 years.
3.2 The user undertakes not to violate applicable law when using the websites. The user also undertakes to refrain from all activities that could endanger the performance and availability of the services.

4. Right of Use
4.1 All content or marks (trademarks, company names, logos) made accessible on the internet pages of neoda Solutions may be subject to copyright, trademark and/or competition law protection. You only receive the right to generate individual search result lists within the scope of normal use based on the data you provided.
4.2 Any further use constitutes misuse and will be pursued by neoda Solutions under civil law and, if applicable, also under criminal law. Misuse includes, in particular
the automated querying of the website by means of software or scripts the copying of the contents of the internet pages, in particular the hit lists (individually or in their entirety) and making them accessible on other internet pages or in other media the exploitation of the provided data, the code or the content of the page the commercial use of the services the editing/modifying of the website excessive use that impairs, endangers, overloads or damages the security or generally the systems or technology of neoda Solutions

5.1 skyando will create links to other websites or content outside of neoda Solutions' internet pages (search results). 5.2 According to Section 8 TDG, neoda Solutions is also not obliged to monitor information transmitted or stored by it or to investigate circumstances that indicate illegal activity.

6. House Rules
In the event of a violation of any of the provisions stated herein, neoda Solutions may take measures to temporarily or permanently exclude individual persons or IP addresses from using this service.

7. Liability
7.1 neoda Solutions is not liable for the accuracy, completeness, or availability of the search results of the skyando search service or any other own or third-party information. neoda Solutions accepts no guarantee for the accuracy of the transmitted data. It is expressly pointed out that the accuracy of the information provided should be checked during the actual booking on the respective provider's website.
7.2 neoda Solutions always endeavours to offer the service free of technical errors and malfunctions, but the user has no claim to this. Likewise, neoda Solutions is not liable for technically caused transmission delays, interruptions, errors, service failures and resulting errors on the part of the user, such as data loss.
7.3 The provisions of gift/loan law (Sections 516 et seq., 598 et seq. BGB) apply accordingly to the provision of the service. neoda Solutions is accordingly only liable for intent and gross negligence.
7.4 Claims due to culpable causation of damage to life, body or health and under the Product Liability Act remain unaffected.
7.5 neoda Solutions is not liable for the accuracy, completeness, or availability of all data provided within the skyando Affiliate Programme. Furthermore, neoda Solutions is not liable for technical errors, failures, or malfunctions towards partners within the skyando Affiliate Programme.

8. Place of Jurisdiction and Applicable Law
The law of the Federal Republic of Germany applies. The exclusive place of jurisdiction is Oldenburg. Status: 01 September 2024
